Terms of Use

These terms govern your use of InstaCognito, operated by Orydelis Technologies Ltd, a company registered in Malta (“we”, “us”). Our full company details are at the end of this page. By using the service, you agree to these terms. Our Privacy Policy explains how we process data.

1. The service

InstaCognito provides analytics and viewing/downloading tools for publicly accessible Instagram information. Free features have usage limits. Paid features, when launched, are those described in your selected plan. We are independent of Instagram and Meta and cannot access private profiles or content.

Reports include estimates and AI-generated analysis based on public information and may be incomplete, inaccurate or outdated. They are not an endorsement or guarantee of a creator’s authenticity, suitability, conduct or future performance, or of any partnership or campaign result. Independently verify material findings before committing money or entering an agreement. If you share reports, preserve their estimate labels and limitations. Public content can become unavailable. These limitations do not reduce our obligation to provide the service as described or your mandatory rights.

2. Accounts and acceptable use

You must be legally able to enter this agreement; paid subscriptions are for users aged 18 or over. Keep your account information accurate and your sign-in details secure, and tell us if your account is compromised.

Your InstaCognito account is part of an account system shared with InstaShadow, a sister service operated by the same company. Where account features are available on InstaShadow, the same sign-in works there and account data is used across both services as described in the Privacy Policy. Your plan description states which services and paid features it covers. These terms govern InstaCognito; InstaShadow has its own terms. If you act for an agency or other organisation, you must have authority to bind it.

Use the service lawfully and respect privacy, intellectual property and applicable platform rules. Do not:

• harass, stalk or expose someone’s personal information for abuse;
• access private content or bypass security checks, profile blocks, payment restrictions or plan limits;
• copy or redistribute content without the necessary permission or legal basis;
• use unauthorised automation, bulk extraction, account sharing or resale, or disrupt the service;
• use reports to infer sensitive personal traits or to make decisions about employment, credit, housing or similarly significant matters.

An “unlimited” plan removes the stated free-tier limits for ordinary use. It does not permit bulk extraction or abuse; any material plan restrictions are disclosed before purchase.

3. Subscriptions and payments

When paid plans are available, checkout will show the features, total price including applicable taxes, currency, billing period and renewal terms before you commit. Unless expressly sold as a one-time purchase, subscriptions renew automatically at the disclosed interval until cancelled. Payments will be processed by the third-party payment provider identified at checkout.

Countries on our greylist or blacklist are blocked at checkout and cannot subscribe to or use paid services. Additional sanctions and payment-provider restrictions may apply. You must not circumvent these controls.

Cancel future renewals from your dashboard or by emailing us before the next renewal is processed. Access normally continues until the paid period ends. Refunds, withdrawal rights and service remedies are explained in our Refund and Cancellation Policy. Deleting your account also stops future renewals.

We will notify you at least 30 days before a renewal price increase takes effect, giving you the opportunity to cancel. Plan changes and any resulting charges are shown before you confirm them.

4. Content and removal requests

Instagram content belongs to its respective rights holders. Access through InstaCognito does not transfer ownership or grant permission to reuse it. We may temporarily cache public content and store report data as explained in our Privacy Policy.

To request a profile block or report a rights violation, email us with the Instagram username or relevant URL, the reason and enough information to assess your request.

5. Changes, suspension and ending access

We may update the service for security, legal requirements or technical improvements. Material changes to paid services will follow applicable consumer law, including advance notice and cancellation or refund rights where required.

We may restrict access where reasonably necessary to address abuse, non-payment, a material breach or legal requirements. We will explain the reason and provide an opportunity to resolve it where appropriate; urgent security or legal issues may require immediate action. If we discontinue a prepaid service without your breach, we refund the unused prepaid portion.

6. Responsibility and disputes

We provide the service with reasonable care and skill. You are responsible for your creator, partnership and campaign decisions, including your own checks and negotiations. An unsuccessful commercial outcome does not, by itself, mean our service was defective or that we are liable.

Business users. If you use the service for business or professional purposes and are not acting as a consumer, then, to the extent permitted by law, we are not liable for lost profits, revenue, business opportunities or goodwill; unsuccessful partnership or campaign expenditure; or indirect or consequential loss arising from the service or reports. Our total liability, whether in contract, negligence or otherwise, is limited to the greater of €100 and the fees paid or payable by you for the affected service in the 12 months before the first event giving rise to the claim.

Rights we do not limit. Nothing excludes or limits liability for fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, or anything that cannot lawfully be excluded or limited. The business exclusions and cap do not apply to consumers or reduce their statutory remedies.

Maltese law governs these terms. Consumers retain the mandatory protections and court rights available under the law of their habitual residence. Please contact us first about any complaint so we can try to resolve it.

We may update these terms, with advance notice of material changes where required. Changes will not retrospectively remove accrued rights.
